National Skill Development Corporation (NSDC), the client, intends for empanelment of Advocates / Law Firms as Legal Service Support to NSDC and hence, Invites expressions of interest (EOI) from eligible and qualified Entity for shortlisting. Entities interested in participating in this bid are invited to submit their proposal / documents against this REOI.

Scope of Work:

The empaneled Advocates / Law Firms will represent NSDC before various judicial and quasi-judicial courts, tribunals, law enforcement agencies and authorities in connection with any legal dispute, litigation, or proceeding. The scope of services to be rendered includes, but is not limited to, appearing and representing NSDC in legal proceedings, providing legal advice and opinions on statutory, regulatory, contractual, and policy matters, conducting legal due diligence of proposals, agreements, drafting, reviewing, and vetting contracts and notices, assisting and representing in arbitration, mediation, settlement, and other dispute resolution mechanisms and rendering any other legal services as may be required by NSDC from time to time. The empanelment shall be on a non-exclusive basis, and NSDC reserves the right to engage any number of Advocates / Law Firms or assign matters to any empaneled advocate/law firms based on their expertise, experience, and availability for specific matters.

Who could apply?

There are 3 categories in which interested and eligible applicants can apply:

  1. Category 1: Advocates / Law Firms with 3–5 Years of Experience
  2. Category 2: Advocates / Law Firms with 5–10 Years of Experience
  3. Category 3: Advocates / Law Firms with 10+ Years of Experience

Submission of Proposals

  • The Entity shall submit a signed and complete Proposal comprising the documents and forms in accordance with the REOI. The Entity shall submit Technical Proposal only through the method mentioned in the REOI.
  • Only one copy of the proposal can be uploaded. An authorized representative of the Entity shall sign the original submission letters in the required format for the Technical Proposal and shall initial all pages. The authorization shall be in the form of a written power of attorney forming a part of the submitted proposal.
  • Any modifications, revisions, interlineations, erasures, or overwriting shall be valid only if they are signed or initialed by the person signing the Proposal.
  • Entity(s) are advised to submit their Proposal strictly based in line with the terms and conditions contained in the REOI documents and without any deviations. Conditional Proposals shall be summarily rejected. However, proposals offered with better specifications/requirements than mentioned in the REOI, if any, may be accepted at the sole discretion of the Client.
  • Entity shall submit their proposal / bid before the deadline mentioned in the important dates through email at procurement@nsdcindia.org.
  • NSDC reserves the right to extend the bid submission date at its sole discretion.

Method of Selection

  • The selection under this REOI will be based on the submission and evaluation of all required documents as per the technical and eligibility criteria.
  • Applications that submit all mandatory documents and meet the evaluation and eligibility requirements will be considered pass bids and eligible for empanelment.
  • The decision of NSDC will be final and binding upon all Entity.

Other Terms and Conditions:

  • The applications received shall be scrutinized by NSDC and its decision shall be final.
  • The number of Advocates / Law Firms to be empaneled shall be determined by NSDC based on its requirement.
  • The empanelment shall be for a period of 3 years which may be extended, on year to-year basis subject to performance of Advocates / Law Firms to the satisfaction of NSDC, upon mutual written agreement between the parties from time to time.
  • The Advocates / Law Firms shall have the right to pursue private practice which should not, however, interfere with or conflict with the efficient discharge of his duties as an empaneled Advocates / Law Firms of NSDC.
  • The Advocates / Law Firms empaneled with NSDC shall not accept any case where NSDC or any of its group entities including parent ministry (Ministry of Skill Development & Entrepreneurship) are opposite parties.
  • NSDC is free to engage any empaneled Advocates / Law Firms of its own choice. The empaneled Advocates / Law Firms shall not make any claim that it should be entrusted with any legal matter(s).
  • In the event of doubt or difference of opinion regarding the terms and conditions of empanelment, the decision of NSDC shall be final and binding and it can-not be challenged in any court of Law.
